Important, please read carefully: Move 2 Madinah operates exclusively as a facilitation and consultation service. We are not a real estate agent, legal representative, licensed broker, government body, or business formation authority. All actions taken on your behalf are facilitated through third-party providers, government departments, and local partners. By engaging our services, you confirm that you have read and understood this distinction.
1. Parties to This Agreement
This agreement is entered into between Move 2 Madinah (the Company, we, us, our), a consultation and facilitation practice based in Madinah, Saudi Arabia, and the individual or family (the Client, you, your) engaging our services.
2. Nature of Services, Facilitation Only
Move 2 Madinah provides consultation, guidance, and facilitation services only. Our role is to advise, connect, guide, and facilitate. We do not directly execute, own, employ, control, or legally represent any third-party process on your behalf. Our services fall within the following three categories:
- Property Rental Facilitation: We provide area guidance, introduce vetted landlords and agents, support negotiations, and assist with the rental process. We are not a licensed real estate agency. We do not hold or transfer property, collect rental payments, or enter into tenancy agreements on your behalf.
- Property Purchase Facilitation: We provide neighbourhood analysis, introduce trusted local contacts, assist with due diligence coordination, and guide you through Saudi foreign ownership regulations. We do not act as a licensed property broker, solicitor, or conveyancer.
- Business Formation & Residency Facilitation: We advise on MISA registration, licensing structures, Iqamah (residency permit) applications, and local banking introductions. We do not guarantee approvals, act as a legal representative, or accept liability for government decisions.
Move 2 Madinah is a facilitator, not the decision-maker. Any confusion between our facilitation role and that of government authorities, landlords, developers, or legal entities is not our responsibility. Clients must ensure they understand this distinction before engaging our services.
3. Scope of Engagement
The scope of each engagement is defined during the initial consultation and confirmed in writing (by email or message). Any additional services requested beyond the agreed scope may require a separate agreement and fee. Move 2 Madinah reserves the right to decline service extensions at its discretion.
4. Fees & Payment
Consultation and facilitation fees are communicated prior to engagement. All fees are non-refundable once a consultation session has been conducted or a facilitation process has commenced, unless otherwise agreed in writing. Fees do not include any third-party costs such as government application fees, agency fees, legal costs, or property deposits. These remain the sole responsibility of the Client.
5. Third-Party Processes & Government Timelines
Many of the processes we facilitate, including Iqamah applications, business licensing, MISA registration, property transfers, and tenancy approvals, are subject to the timelines, policies, and decisions of Saudi Arabian government authorities and third-party service providers. Move 2 Madinah has no control over, and accepts no liability for, any of the following:
- Delays caused by government processing times or policy changes
- Changes to Saudi regulations, visa rules, or ownership laws
- Decisions made by landlords, developers, banks, or legal authorities
- Rejection of applications by any government body
- External market conditions affecting property pricing or availability
- Force majeure events including but not limited to natural disasters, political developments, or pandemic-related restrictions
The Client acknowledges that timelines provided are estimates based on general experience and are not guarantees. We will keep Clients informed of progress and any known delays as soon as reasonably possible.
6. No Guarantees of Outcome
While Move 2 Madinah uses its best efforts, experience, and network to support each Client, we make no guarantee of any specific outcome, approval, timeline, or result. Relocation, residency, business formation, and property acquisition are inherently complex processes involving multiple parties. The Client accepts full responsibility for final decisions made.
7. Client Responsibilities
By engaging Move 2 Madinah, you agree to:
- Provide accurate, complete, and timely information required for your engagement
- Disclose any factors that may affect your eligibility for residency, property ownership, or business licensing in Saudi Arabia
- Act on guidance provided in a timely manner. Delays caused by the Client are not the responsibility of Move 2 Madinah
- Ensure that all documents submitted to third parties are accurate and authentic
- Comply with all applicable Saudi Arabian laws and regulations
- Understand and accept the facilitation-only nature of our service before proceeding
8. Confidentiality
Move 2 Madinah treats all Client information with strict confidentiality. We do not maintain a public client list and do not share personal details with third parties except where necessary to facilitate the agreed service (e.g., with landlords, agents, or registration bodies) and only with prior Client knowledge. Clients may provide testimonials voluntarily; names and identifying details are withheld unless explicit written permission is given.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Move 2 Madinah shall not be liable for any indirect, consequential, incidental, or special damages arising from or in connection with our services, including but not limited to financial loss, loss of property, business interruption, or delays caused by third-party or government processes. Our total liability to any Client shall not exceed the total fees paid by that Client for the specific service giving rise to the claim.
10. Communication & Response Times
Move 2 Madinah communicates primarily via email, WhatsApp, and video consultation. We aim to respond to enquiries within 48 hours during working days. Response times may vary during holidays, high-demand periods, or circumstances beyond our control. All formal agreements, scope confirmations, and material updates will be communicated in writing.
11. Intellectual Property
All content, guides, frameworks, tools, and materials produced by Move 2 Madinah, including website content, consultation frameworks, and any documentation provided, remain the intellectual property of Move 2 Madinah. Clients may not reproduce, share, or commercialise any materials provided to them without prior written consent.
12. Amendments to These Terms
Move 2 Madinah reserves the right to update these Terms & Conditions at any time. The most current version will be published on move2madinah.co. Continued engagement with our services following any update constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes arising from this agreement shall be referred in the first instance to good-faith mediation between the parties. Where resolution cannot be reached, disputes shall be subject to the jurisdiction of the competent courts of Madinah, Saudi Arabia.
